The Dynamic AED (automated external defibrillator) Registry (hereinafter, the "Registry") is conducted by the University of Washington School of Medicine (the “University”). The administrator of the Registry is the Dynamic AED Registry Study Leadership Team within the Department of Medicine, Division of General Internal Medicine, UW Harborview Center for Prehospital Emergency Care, (the “Study Leadership Team”).
Participants are welcome to register either as individuals or as teams made up of several persons. If the Participant is a team, the team must designate a team leader who will serve as the designated Participant (as used in these Terms and Conditions) and be the sole recipient of communications from the Study Leadership Team and the sole person to communicate with the Study Leadership Team regarding the Registry.
Participants can represent themselves or be the authorized representatives of a partnership, corporation, academic institution, or student group. If a Participant is an employee of a corporation or academic institution, enrolled as a student or otherwise representing their employer or academic institution in this Registry, it is their sole responsibility to review, understand and abide by their employer's or academic institution's policies affecting their eligibility to participate in the Registry. If a Participant is found to be in violation of their school's or employer's policies, they will be disqualified from the Registry. The University disclaims any and all liability or responsibility for disputes arising between a student or employee and their school or employer related to this Registry. The University also disclaims any and all liability or responsibility for disputes within a team or between the “designated Participant” and the team he/she represents.
The Registry is open to individuals of any age, of any residency or nationality.
The Registry is void for those countries and for residents of those countries where prohibited or restricted by US or Washington State law. The Study Leadership Team reserves the right to limit, or restrict upon notice, participation in the Registry at any time for any lawful reason.
To enter the registry, a Participant must register as a team or individual on the project web site (heartmap.uwctc.org) and complete all required data. Any mobile phone charges accrued from the transmission of information (via text, email, or other) in the Registry are the sole responsibility of the Participant. Participants must accurately and fully complete the registration information request.
By submitting an entry, a Participant gives permission for his/her name and home town to be released to the Study Leadership Team. Participant information will not be sold, but may be used for research purposes by persons affiliated with the University during and after the completion of the Registry. No other personally identifiable information will be published without the Participant's permission.
By registering, Participants agree to be bound by these Rules, and agree that all photos and data submitted for the Registry become the property of the study leadership team and may be used for any purpose. Without limitation, the AED data collected may be used for research, may be provided to emergency medical services (EMS), and may be used for mobile and web applications that provide AED data.
Team Participants must provide a team name and identify the team leader. The study leadership team in its sole discretion may change any inappropriate, publicly displayed team data, including the team name. The Participant's registration acts as consent to be bound by these rules for both the team leader and every member of the team.
To provide information about an AED location, Participants will submit "required" data via the project web site.

Participants may also enter additional information, labeled "optional," about the AED on the project web site.
Eligible AEDs are those that are in fixed locations (installed, moored, wall-mounted) or assigned to a fixed location (e.g. drawer, shelf, cabinet, closet). For example, AEDs in police cars or on airplanes would not count for Registry submission. Further eligible AEDs are not those in a personal residence, such as someone's home.
The Study Leadership Team will verify entries in the following way:
The locations of many AEDs in the region are already known. The Study Leadership Team and affiliated members may personally check a sample of submitted AEDs from those not on our list by visiting the locations and verifying all the information or by using other means to confirm the accuracy of the information. The Study Leadership Team reserves the right to make all decisions, in its discretion, arising out of or relating to the Registry, including but not limited to determinations regarding submissions and whether any is incorrect or false in any manner. Any decision made by the Study Leadership Team as to the accuracy of a submission, or any instance of suspected fraud or abuse in the operation of the Registry, is final and binding and may not be challenged by any Participant or other interested party.
By participating in the Registry, each Participant grants to the University an irrevocable, perpetual, non-exclusive, royalty-free license to exercise any copyright or other proprietary in data submitted by the Participant. All submitted information must be lawfully obtained. Any violation of law or trespass committed by or on behalf of a Participant during the course of Registry participation, as determined by the University, will subject the Participant to disqualification.
Locations without AEDs or that an individual or team "wishes" had an AED Participants may also submit information regarding locations without AEDs, or locations the Participants wish had an AED. This information is submitted at the discretion of the Participant. These reported addresses may be posted on the project website.
All Participants must play fair. This means that Participants must obey the law and may not interfere with the activities of other Participants. Participants may not tamper or interfere with the operation of the Project web site or mobile applications, or attempt to do so.
Each Participant is solely responsible for the equipment and Internet access required to register, participate in the Registry, and submit information. The study leadership team takes no responsibility for lost, late, incomplete, stolen, misdirected, undelivered, delayed, inaccurate, garbled or incomprehensible information, or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or for garbled or jumbled transmissions, or for service provider/Internet/Web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention, or for inaccurate capture of any information, or the failure to capture any such information, irrespective of the cause of such occurrence, including, without limitation, errors or failures which may occur in connection with the processing or storing of information, the administration of the Registry, the uploading, processing, validating, posting of entries, or in any Registry-related materials.
All activities relating to Participant's participation in the Registry and information submitted are subject to verification and/or auditing for accuracy and/or compliance with these Rules. Participants agree to reasonably cooperate with the Study Leadership Team in any such verification and/or auditing. In the event that Registry verification activity or an audit uncovers non-compliance with the Rules or official Registry communications, as determined in the Study Leadership Team's sole discretion, a Participant's continuing participation in any aspect of the Registry may be suspended or terminated.
The Study Leadership Team reserves the right, in its sole discretion, to suspend or cancel the Registry should any virus, bug and/or other cause corrupt the administration, security or proper operation of the Registry.
The Registry and its continuing terms and conditions, benefits and participation are offered to Participants at the sole discretion of the Study Leadership Team, which reserves the right to amend or interpret the Rules or official Registry communications and any element or elements thereof at any time, upon published notice to Participants on the Registry Web site. A Participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same and shall be deemed to have accepted such amendments or interpretations by virtue of a Participant's continuing participation in the Registry. Should a Participant not wish to continue to participate in the Registry pursuant to the prevailing Rules, as amended or interpreted, a Participant may terminate participation in the Registry by abandoning their registration on the Site. All submitted material remains the property of the University.
The Study Leadership Team has the sole discretionary authority to construe the terms of these Rules, to reconcile any inconsistency, and to make determinations and reach conclusions, including both factual findings and the application of these Rules to such facts. The Study Leadership Team reserves the right to make all decisions, in its discretion, arising out of or relating to instances of suspected abuse, fraud, error or anomalies in the operation of the Registry, including the Registry Web site, or any other interpretation, activity or suspected violation relating to the Registry, and such decisions are final and binding. The Study Leadership Team reserves the right to disqualify any Participant or team for actions deemed to violate the spirit of the Registry for any reason, including but not limited to the violation of laws or regulations in the course of participation.
Any aggrieved Participant further agrees to submit to the Study Leadership Team via certified mail to UW Harborview Center for Prehospital Emergency Care, Box 359727, 325 Ninth Avenue, Seattle, WA 98104 for internal adjudication a written statement concerning and fully describing any grievance for review and response. The response and decision by the Study Leadership Team shall be final and binding on a Participant.
THE UNIVERSITY, AS WELL AS EACH OF ITS
RESPECTIVE OFFICERS, TRUSTEES, FACULTY, EMPLOYEES, REPRESENTATIVES AND AGENTS
AND SPONSORS OF THE REGISTRY INCLUDING THE AMERICAN HEART ASSOCIATION, MEDIC
ONE FOUNDATION AND NICK OF TIME FOUNDATION (COLLECTIVELY, THE "RELEASED
PARTIES") EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS OF ANY KIND
(WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED
TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES SHALL RELEASED
PARTIES BE HELD RESPONSIBLE OR LIABLE FOR ANY USE OF THE INFORMATION AND/OR
PRODUCTS PROVIDED AND/OR MADE AVAILABLE IN CONNECTION WITH THE REGISTRY OR FOR
ANY ERRORS OR ANOMALIES RELATING TO THE REGISTRY OR ANY INFORMATION CONNECTED
WITH IT, ANY UNINTENDED OR ERRONEOUS PARTICIPATION IN THE REGISTRY. RELEASED
PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES OR CONDITIONS THAT THE
REGISTRY, REGISTRY WEBSITES, REGISTRY MOBILE APPLICATIONS OR REGISTRY
INFORMATION WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE
ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED IN CONNECTION WITH THE
REGISTRY. RELEASED PARTIES ASSUME NO RESPONSIBILITY FOR ANY COMPUTER-RELATED
DAMAGES DUE TO DOWNLOADING MATERIALS. RELEASED PARTIES WILL NOT BE LIABLE, AND
ARE NOT RESPONSIBLE, FOR DAMAGES OF ANY KIND RELATED TO A PARTICIPANT'S
PARTICIPATION OR INABILITY TO PARTICIPATE IN THE REGISTRY, WHETHER THE DAMAGES
ARE DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, OR OWING TO
PARTICIPATION, ANY DECISION TO CANCEL THE REGISTRY, OR OTHERWISE. FURTHER, BY
PARTICIPATING IN THE REGISTRY, A PARTICIPANT AGREES THAT RELEASED PARTIES SHALL
NOT BE LIABLE FOR, AND WILL BE HELD HARMLESS BY PARTICIPANT AGAINST, ANY
LIABILITY FOR ANY DAMAGE, INJURY OR LOSS TO PERSON (INCLUDING DEATH) OR
PROPERTY DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO PARTICIPATION IN
ANY REGISTRY-RELATED ACTIVITY; OR RELEASED PARTIES' USE OF ANY TENDERED ENTRY
OR PARTICIPATION IN THIS REGISTRY.
Participants agree to release, defend, indemnify and hold harmless Released Parties from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages or proceedings, including but not limited to property damage, personal injury, or death, and including a reasonable attorney's fee, relating to any action taken by a Participant, including but not limited to efforts to locate AEDs, or the submission of location information, or anyone else using a Participant's registration or team password, acting as a member of Participant's team, or otherwise purporting to act on Participant's behalf in regard to the Registry (whether or not such use occurred with or without Participant's permission). Participant also agrees to release, defend, indemnify and hold harmless the Released Parties from any and all liability, claims, losses, damages or proceedings, including but not limited for death (including reasonable attorneys' fees) relating to any other matter in connection with a Participant's participation in the Registry or the University's use of Participant's registration or information submitted.
